The Minna Chief Magistrate court Number One has granted the order for the service of substituted summons Through the Village head of Doko in Lavun Local govermnat area of Niger State Alhaji Abdullahi Yahaya Madiu on Alhaji Isah Ndaceko and twenty four defendants in civil case brought against the defendants by the plaintiff Alhaji Yunusa Ibrahim Adesa.
This followed an application made before the court by their counsel in the matter Barrister Tajudeen Olaosebikan .
According to the defense counsel, the application was brought pursuant order five rule two of the Magistrate court rules, that substituted service should be served out through the Village head of Doko Community were all the defendants reside.
Granting the application as made by the counsel, the presiding Chief Magistrate Hajiya Ummulkhatum Mohammed, said, ” the application made by the Counsel is hereby granted . A substituted Service should be effected on all the defendants through of the said Doko Community.
” Inview of the above, this case is adjourned to the 13th November 2023, for mention.
Earlier, in his application, Barrister Tajudeen Olaosebikan told the court that all efforts to serve the defendants with the service has not be successful as the the defendants have Severally evaded the service .
” Your Worship, these defendants have been proving very dificult to be serve the service from this court.
” On two occasions, a bailif from this court one Musa Mohammed went to serve them the service, he narrowly escaped been lynched. The second attempt another bailif from this court went to serve them they violently refused to be serve.
” My Lord, it is against this reasons I made this application for the court to serve them substituted service through the Village head of Doko Community for them to appear before this honourable court” he told the court.
In a writ of summons filed before the Court and obtained by this reporter, the defendants had on the 24th of April 2023, conspired among themselves without any provocation,from the plaintiff ” and while he was relaxing at his home they launched an offensive on his house”
According to the writ, the defendants jointly set the house ablaze, which he said was completely burnt down the picture of the burnt property is pleaded to be relied upon by the plaintiff at the hearing of the suit requesting the court to be moved at the hearing of the case to the locus to see the destroyed properties
Equally, the writ revealed that the deffendants vandalized another house belonging to the plaintiff and shattered all the glasses of the windows and doors adding that the pictures showing the vandalized storey building is also pleaded” and shall be relied upon by the plaintiff at the resume hearing of the matter in court
At this point the Chief Magstrate Hajiya Ummulkhatum Mohammed upon hearing the application as moved by the deffence counsel, she the adjourned the matter to the 13th of November 2023 for the commencement of hearing into the matter.
