The National and State Assembly Election Petition Tribunal (NAEPT), sitting in Minna has dismissed the petition filed against Mohammed Abubakar of the All Progressive Congress (APC) by Aminu Garba of People Democratic party (PDP)
The Petitioner who contested the State House of Assembly Election of Chanchaga state Constituency of the 18th March, 2023, approached the tribunal challenging the election of the respondent.
The Petitioner further claimed that the respondent did not scored the lawful votes at seven polling units in Tudunwada ward of Chanchaga Constituency as the election in the unit were marked with irregularities and other electoral malpractices.
Aminu Garba has filed the petition requesting the tribunal to nulify the election of Mohammed Abubakar on the ground of none compliance with the electoral act 2022.
He approached the tribunal with the request to nulify the election and declare him the rightful winner of the election as he scored the majority of vote cast at the 18 March, 2023
The Petitioner also requested for the withdrawal of the certificate of return already issued to the respondent by the first respondent the Independent Electoral Commission (INEC), and declare him the winner.
He claimed in his Petition that the form Ec 8 was not duely signed by the presiding officer which according to him rendered the election invalid and non compliance with the provision of the electoral act 2022.
After painstakingly reviewing the submission of the legal team of the both parties Justice Mojisola Ishaq Sule asserted that the petitioner failed to prove the allegations concerning the non compliance with the provision of the electoral act as claimed by the petitioner .
She then dismissed the petition as the the petitioner failed to establish and prove his claimed describing all the evidences and submission tendered before the tribunal as hear say which according to her could not hold water ” and the petition is hereby dismissed and the election of the Mohammed Abubakar Conducted on the 18 March, 2023 is upheld”
